It also describes your rights regarding our use of your data. In collecting your personal data we are acting as a data controller.

We may collect your data in the following ways:

  • Information you give us – This could be by visiting our website, by filling in a form, by purchasing and/or using a product or service from us, by communicating with us via email, web forms, social media, telephone calls, chat or other methods of communication, by signing up for a webinar or attending an event, by subscribing to receive 1Spatial marketing material, by applying for a job or by providing services to us.
  • Information we collect about you via automated means – When you visit our website, view a 1Spatial advertisement on a third-party website or read an email, we may automatically collect information about you via cookies, tags and similar technologies.   • Information we receive from other sources – We may receive information from third parties, such as independent exhibition organisers, suppliers, partners, sub-contractors, social media platforms and paid advertising platforms. We have carefully selected these third parties through a due diligence process to ensure that Personal Information is adequately protected.
  • Information we may collect from publicly available sources – from time to time, we may collect personal data about you, which can be collected from publicly available sources (including open source data sets or media reports) or that you or a third party has made publicly available.

What type of personal data do we collect?

In providing our website, services and processing any job applications, we may collect and process different types of personal data about you for different processing purposes. The types of personal data we collect depends on who you are and how you interact with us and includes the following:

When you browse our website, we collect and process Technical Data to help us understand how you are using and navigating our site. We do this so that we can better understand how you may wish to use our products and services and to ensure we can preserve network and information security.

We may collect and process Identity data, Contact data, Transactional data whether you are interacting with us on your own behalf or on behalf of any organisation you represent.

It is necessary for us to use your personal data to perform our obligations in accordance with any contract that we may have with you for the services, or it is in our legitimate interest or a third party’s legitimate interest to use personal data in such a way to ensure that we provide our services in an effective, safe and efficient way.

If you have a general question or need help with any issue concerning our services

When you make an enquiry, we will collect and process your Identity data, Contact data and, if applicable, certain Transactional Data, as well as any other personal data you volunteer that is relevant to your enquiry.

Hosting and managing events or webinars

From time to time, we may organise, sponsor and host events or webinars for the purpose of promoting our business or other reasons. If you register for or attend one of our events or webinars, we may use your Identity data and Contact data to record your attendance at the event or webinar and for related record-keeping purposes and, if relevant, we may collect and process any dietary requirements you may have. You may also feature in photographs taken at our events and such photographs may appear in publications that we make available.

It is necessary for us to use your personal data in this way to perform our obligations in accordance with any agreement that we may have with you where you have signed up to attend an event or webinar, or it is in our legitimate interest or a third party’s legitimate interest to use your personal data in such a way to ensure that the event or webinar is operated in an effective way. We may also send you communications that may appeal to you after the event or webinar. We may specifically ask your permission to use your photographs or when asking you about dietary requirements.

Direct marketing

We use your Identity data, Contact data and Marketing and communications data to send you (or the organisation you represent) marketing communications by email.

It is in our legitimate interest to use your personal data for marketing purposes, for example to decide what marketing content we think may appeal to you.
It is in our legitimate interest to use your personal data to send our marketing to you by post or to your business (or work) email address.

Job applications

If we use your personal data in connection with our recruitment activities

We use your Job application data for recruitment purposes, in particular, to assess your suitability for any of our positions that you apply for, whether such application has been received by us online, by email or by hard copy and whether submitted directly by you or by a third-party recruitment agency on your behalf. We also use your Identity data and Contact data to communicate with you about the recruitment process, to keep records about our recruitment process and to comply with our legal and regulatory obligations in relation to recruitment.

Where we use your personal data in connection with recruitment, it will be in connection with us taking steps at your request to enter into a contract we may have with you or it is in our legitimate interest to use personal data in such a way to ensure that we can make the best recruitment decisions.
We will not process any special (or sensitive) categories of personal data or personal data relating to criminal convictions or offences except where we are able to do so under applicable legislation or with your explicit consent.

How long do we store your data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements. Sharing personal data

We only share personal data with others when we are legally permitted to do so. When we share personal data with others, we make sure that there are appropriate contractual and security arrangements in place to ensure the continued safeguarding of your personal data.

We may share your personal data with others such as our third-party suppliers, payment providers, any relevant advertising partners, any event partners or professional advisers.

Such recipients of data may be based outside the United Kingdom or European Economic Area (“EEA”) who we engage to help us, amongst other things, fulfil your order, process your payment details and/ or provide support services. We only transfer your Personal Information outside of the UK or EEA:

  • Where the transfer is to a place that is regarded by the UK Government or European Commission as providing adequate protection for your Personal Information.
  • Where we have put in place appropriate safeguards.
  • Where you have consented to it, or there is another legal basis to allow us to make the transfer.

The security of all personal information is very important to us. We have taken the necessary and appropriate technical and security measures to safeguard personal data, which we review routinely. In the UK, we are certified to Cyber Essentials Plus and are working towards achieving certification of the international information security standard, ISO/IEC 27001.

The site may from time to time contain links to the websites of our partner networks, or other third party organisations. If you follow a link to any of these websites, we do not accept any responsibility or liability for the way they handle your personal data or their privacy practices.  You should exercise caution and look at the Privacy Policy applicable to the website in question in order to be familiar with how such third parties will handle your personal data.

We acknowledge that the information you provide may be confidential. We do not sell, rent, distribute or otherwise make Personal Information commercially available to any third party, but we may share information with our service providers for the purposes set out in this Privacy Notice. We will keep your information confidential and protect it in accordance with our Privacy Notice and all applicable laws.

Your rights as a data subject

We respect and place significant importance on your rights.  If you wish to exercise any of these rights, please email data.protection@1spatial.com or, in the case of your right to opt out of direct marketing, follow the instructions below. To process your request, we may ask you to provide identification details for verification purposes.

Your rights are as follows:

  • The right to opt out of direct marketing

You may opt out of receiving direct marketing at any time. You may exercise this right by following the “unsubscribe” link on our website, following the unsubscribe link in relevant emails or by emailing us at: data.protection@1spatial.com.

  • The right to be informed

As a data controller, we are obliged to provide clear and transparent information about our data processing activities and the data that we hold about you. This is provided by this privacy notice and any related communications we may send you.

  • The right of access

You may request a copy of the personal data we hold about you free of charge. Once we have verified your identity and, if relevant, the authority of any third-party requestor, we will provide access to the personal data we hold about you.

You will not have to pay a fee to access your personal data. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may respond in an appropriate or proportionate manner to your request.

  • The right to rectification

If you believe we hold inaccurate or incomplete personal information about you, you may exercise your right to correct or complete this data. This may be used with the right to restrict processing to make sure that incorrect/incomplete information is not processed until it is corrected.

If you believe that any information we have about you is incorrect or incomplete, please contact us data.protection@1spatial.com as soon as possible. We will take steps to seek to correct or update any information that we hold to be inaccurate.

  • The right to erasure (the ‘right to be forgotten’)

Where no legal basis or legitimate reason continues to exist for processing personal data, you may request that we delete the personal data. We will take all reasonable steps to ensure erasure. If we have shared your personal data with others, we will let them know about the erasure where possible.

  • The right to restrict processing

You may ask us to stop processing your personal data. We will still hold the data but will not process it any further. This right is an alternative to the right to erasure.

  • The right to data portability

You may request your set of personal data be transferred to another controller or processor, provided in a commonly used and machine-readable format. This right is only available if the original processing was done on the basis of consent, the processing is by automated means and if the processing is based on the fulfilment of a contractual obligation.

  • The right to object

You may object to the processing of your Personal Information by us. If we are unable to demonstrate our legitimate grounds for that processing, we will no longer process your Personal Information for those purposes. You may also object to the processing for the purpose of direct marketing (see above) or if processing involves automated decision-making and/or profiling.

  • Your right to complain

We regularly review and, if appropriate, update this privacy notice from time to time, and as our services and use of personal data evolves.
